Open Internet Disclosure Statement

The Federal Communications Commission’s Internet Freedom transparency rule, 47 CFR § 8.1, requires an Internet service provider, or ISP, to publicly disclose information about its network management practices, performance characteristics, and commercial terms of its Internet access services. This document is meant to disclose the general practices of BTWI (Bits of Technology Wireless Internet, Bits of Technology LLC) in conjunction with residential and commercial fixed wireless internet services. This document is to be viewed in conjunction with BTWI’s “Usage Agreement for Wireless Internet”.

Network Management

Blocking: BTWI does not practice blocking, outside of reasonable network management, any traffic that prevents end users access to lawful content, applications, service, or non-harmful devices.

Throttling: BTWI does not practice throttling, other than reasonable network management as described in BTWI’s user agreement, that degrades or impairs access to lawful internet traffic on the basis of content, application, service, user, or use of a non-harmful device.

Affiliated Prioritization: BTWI does not practice prioritization that directly or indirectly favors some traffic over other traffic, including through the use of techniques such as traffic shaping, prioritization, or resource reservation, to benefit an affiliate, including identification of the affiliate.

Paid Prioritization: BTWI does not practice prioritization that directly or indirectly favors some traffic over other traffic, including through the use of techniques such as traffic shaping, prioritization, or resource reservation, in exchange for consideration, monetary or otherwise.

Congestion Management: BTWI uses Preseem traffic management to control congestion within the network. Preseem's traffic management is application and protocol agnostic. It functions by carefully managing the packets sent to the subscriber on a flow (layer 4) basis within the subscriber's allocated (plan) bandwidth to achieve a good quality of experience. , Preseem will manage the bandwidth assigned to the access point in the same application and protocol agnostic way as the subscriber plan bandwidth. AP shaping is typically used to manage AP level network congestion and to ensure fairness among the subscriber's sharing the congested AP's bandwidth.

Application-Specific Behavior: BTWI does not block or rate control specific protocols or protocol ports, modify protocol fields in ways not prescribed by protocol standards, or otherwise inhibits or favor certain applications or classes of applications.

Device Attachment Rules: BTWI does not restrict any types of devices or have any approval procedures for legal devices that connects to BTWI’s network.

Security: BTWI uses industry standard tools and best practices and policies to protect our customers and our network from malicious and unwanted Internet traffic such as preventing the distribution of viruses or other harmful code and preventing the delivery of DDOS attacks to the network. In general, these security practices should not have any effect on our subscribers’ use of their network connections. In the instances where these tools and policies identify on-line content as harmful or unwanted a mechanism may be invoked to block harmful IP's at the edge of the network. BTWI may also block certain ports for internal network use only to ensure security.

Performance Characteristics

Service Description: BTWI offers fixed wireless internet service. This service is dependent of line of sight from customers to access points. Fixed wireless performance can be impacted by heavy subscriber use and open line of sight. Customer bandwidth shall be limited to a maximum rate to be specified on your application of service. Actual speeds may vary, but the Committed Information Rate is guaranteed to be a minimum of 50% of you contracted sustained rate. BTWI has built its fixed wireless network to overcome and avoid disruptions in service performance to the end users. However, to ensure a quality experience for end users BTWI uses various network management tools.
Impact of Non-Broadband Internet Access Service Data Services: BTWI customers receiving both internet and voice services should not expect to experience any performance issues on broadband internet access. BTWI uses QoS protocol through Preseem that shapes the Internet traffic giving priority to specific types of traffic such as voice, video, etc. preventing performance issues that affect last mile capacity from Non-broadband data services.

Any questions and or complaints will be reviewed and addressed in a reasonable time frame by representatives of BTWI who are deemed to be properly trained and the most qualified individual to properly answer questions and or resolve complaints. If a customer believes that BTWI is not in compliance with the FCC’s rules, the customer may file an informal complaint with the FCC. Digital Millennium Copyright Act ("DMCA")

1. Notice.
BTWI Wireless Internet respects the intellectual property rights of others. Per the DMCA, BTWI Wireless Internet will respond expeditiously to claims of copyright infringement on the Site if submitted to BTWI Wireless Internet's Copyright Agent as described below. Upon receipt of a notice alleging copyright infringement, BTWI Wireless Internet will take whatever action it deems appropriate within its sole discretion, including removal of the allegedly infringing materials and termination of access for repeat infringers of copyright protected content. If you believe that your intellectual property rights have been violated by BTWI Wireless Internet or by a third party who has uploaded materials to our website, please provide the following information to the designated Copyright Agent listed below:

  1. Description of the copyrighted work or other intellectual property that you claim has been infringed.
  2. Description of where the material that you claim is infringing is located on the Site.
  3. An address, telephone number, and email address where we can contact you and, if different, an email address where the alleged infringing party, if not BTWI Wireless Internet, can contact you.
  4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner or other intellectual property rights owner, by its agent, or by law.
  5. A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner's behalf.
  6. Your electronic or physical signature.

BTWI Wireless Internet may request additional information before removing any allegedly infringing material. In the event BTWI Wireless Internet removes the allegedly infringing materials, BTWI Wireless Internet will immediately notify the person responsible for posting such materials that BTWI Wireless Internet removed or disabled access to the materials. BTWI Wireless Internet may also provide the responsible person with your email address so that the person may respond to your allegations.

2. Counter-Notice.
Regarding any content that was removed or disabled, if you believe that your content is not infringing or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice to our Copyright Agent. When our Copyright Agent receives a counter-notice, we may send a copy of the counter-notice to the original complaining party informing that party that we may, in 10 business days, replace the removed content or stop disabling it. Unless the copyright owner files an action seeking a court order against the provider of the content, the removed content may be replaced or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, in our sole discretion.

BTWI Wireless Internet’s intellectual property policy is to: (a) remove or disable access to material that BTWI Wireless Internet believes in good faith, upon notice from an intellectual property rights owner or his or her agent, is infringing the intellectual property rights of a third party by being made available through the Service; and (b) in appropriate circumstances, to terminate the Accounts of and block access to the Service by any User who repeatedly or egregiously infringes other people’s copyrights or other intellectual property rights.


BTWI Subscriber Privacy Policy

This subscriber privacy policy describes how Bits of Technology LLC, also known as BTWI and BTWI Wireless Internet, collects information from and about you, as well as how we use and protect that information. By applying for and continuing use of service with BTWI you agree to terms of the privacy policy.

Personal Information
To provide you with internet Services, BTWI collects your personal information. This can include information that does not personally identify you — such as device numbers, IP addresses, and account numbers. It may also include information that does personally identify you, such as your name, address, and telephone number. If you allow others to use your BTWI accounts or Services, we will also collect personal information about those individuals. If you are not a BTWI customer, but use our Services through someone else’s account, we will collect information about you, this information may not identify who you are. We may also collect information about you from third parties. We collect this information to provide our Services, respond to your requests, and to tailor our Services to best meet your needs and interests.

Use of Information
BTWI uses the information we collect to provide our Services and communicate with you. We also use it to improve our Services, develop new products and services, give recommendations, deliver personalized marketing and advertising for our own and others’ products and services, investigate theft and other illegal activities, and to ensure a secure online environment. We may combine information across our systems, platforms, and databases. This includes combining information we receive from third parties and information about your use of our Services. We may also combine information about your use of one Service with information we get from your use of another Service.

Information Disclosure
BTWI does not sell information that identifies who you are to anyone. This includes your Internet usage information, video usage information, or call detail information. We share personal information with others when it’s needed to provide you with our Services. We also share personal information with others when you direct us to do so, including to authorize other users on your account, when required by law or to respond to legal process, and to protect our property or rights or the safety of our employees, our customers, or other individuals. If we share your personal information with other companies for their own marketing and advertising activities, we will first get your consent. This may be through opt-in or opt-out settings, depending on the type of personal information shared. We may also share personal information that does not identify you with third parties for their own marketing and advertising purposes. This mainly occurs when you interact with our websites and mobile applications that contain third-party cookies or other advertising trackers.

How We Protect Your Information
BTWI follows industry-standard practices to secure the information we collect to prevent the unauthorized access, use, or disclosure of any personal information we collect and maintain. These security practices include technical, administrative, and physical safeguards, which may vary, depending on the type and sensitivity of the information. Although we take the responsibility of safeguarding your personal information seriously, no security measures are 100% effective and we cannot guarantee that these practices will prevent every unauthorized attempt to access, use, or disclose your information.

How Long We Keep Your Information
BTWI keeps your personal information for different lengths of time depending on the type of information and the business and legal requirements. If you no longer subscribe to a Service, we still may need that information for business and legal requirements.

Changes to this Privacy Policy
BTWI may change this Privacy Policy over time as our business needs and those of our customers change. If we make material changes to this Privacy Policy that increase our rights to use personal information that we have previously collected about you, we will notify you through written, electronic, or other means so that you can make any necessary decisions about your ongoing use of our Services.
